أشهد أنا المستشار أحمد سليمان وزير العدل المصرى الأسبق أن النظام القائم فى مصر يحتقر القانون والدستور ولايعبأ بهما وتتلبسه رغبة عارمة فى تصفية خصومه ، كما أن القضاء المصرى المدنى والعسكرى يمر بمحنة لم يمر بها من قبل ، فأصبح يخالف أحكام القانون علنا وعمدا ، ولايبالى بمصادرة حقوق الدفاع ويقضى فى العديد من الدعاوى على خصوم النظام بالسجن المؤبد والإعدام للمئات دون دليل قانونى معتبر واستنادا لمحاضر التحريات وحدها ، ومن ثم اهتزت ثقة الرأى العام فى أحكام القضاء فى الداخل والخارج ، كما أن المنظمات الحقوقية الدولية باتت تنظر إليه باعتباره أداة انتقام فى يد النظام وذلك استنادا للأدلة الآتية :
أولا : أن السلطة القائمة منذ وقوع الانقلاب أسندت للعديد من أبناء مصر أفعالا لايعاقب عليها القانون ، ورغم ذلك تقرر النيابة العامة حبسهم كما حدث مع الطفل الذى ضبطت لديه مسطرة تحمل شعار رابعة ، أو ذلك الغلام الذى ارتدى قميصا عليه عبارة وطن بلا تعذيب فأمضى فى السجن نحو عامين وغيرهم كثير ، وكذلك تقديم متهمين للمحاكمة فى قضايا قام الدليل على عدم صحتها مثل قضية سد البلاعات فى الأسكندرية التى اتهمت جماعة الإخوان بارتكابها وتم تقديمهم للمحاكمة رغم إفادة المحافظة أن هذه البلاعات سدًت نتيجة إلقاء كتل أسمنتية فيها أثنا إنشاء عدد من الأندية على مقربة منها ، وأن ذلك منذ نحو عشرين عاما .، ورغم ذلك تم تقديم نحو 33 متهما للمحكمة العسكرية التى قضت بالسجن المؤبد ل 12 متهما ، والسجن 15 عاما ل 21 متهما .
ثانيا : أن المجلس القومى لحقوق الإنسان الحكومى المصرى قد رصد فى عدة تقارير أن المشكلة الرئيسية تكمن فى التوسع فى قرارات الحبس الاحتياطى وأنه بات فى حد ذاته يمثل عقوبة لايمكن التعويض عنها ، كما أشارت بعضها إلى أن تجديد الحبس يتم فى غيبة المتهمين وذلك أمر مخالف للقانون لايخفى على السلطة القائمة بالتجديد .
ثالثا : أن السلطة القائمة تعتمد أسلوب تزوير التحريات أداة للانتقام من كل من ترغب فى الانتقام منه ، وقد أذاعت قناة مكملين تسجيلا لضابط الأمن الوطنى الذى حرًر محضر تحريات قضية الاتحادية وهو يعترف أنه قد صاغها من بنات أفكاره للخلاص من الرئيس مرسى وجماعته ، كما أن محضرى التحريات فى قضيتى قضاة البيان وقضاة من أجل مصر تضمنا وقائع مختلقة ولا أساس لها من الصحة وقد طعن القضاة عليها بالتزوير أمام مجلسى التأديب وقدموا بلاغين بالواقعتين للنائب العام ولم يحققا لا فى النيابة ولا أمام مجلسى التأديب وتم عزل عشرات القضاة استنادا اليهما .
رابعا : أن دوائر الإرهاب تم تشكيلها من قضاة معينين للفصل فى قضايا بعينها ، والكثير منهم تحوم حوله الشبهات وكانت لبعضهم تحقيقات مفتوحة تم إغلاقها قبيل تشكيل هذه المحاكم ، وقد أهدر الكثير منهم قواعد القانون وضمانات المحاكمات العادلة ، كما فعلت دائرة سعيد يوسف برفضها منح المتهين فى قضيتى اقتحام مركزى العدوة ومطاى أجلا لردً المحكمة ، وعدم سماعه لدفاع المتهمين ونظر القضيتين اللتين زاد عدد المتهمين فى كل منهما على 500 متهم فى سويعات قليلة فى جلستين فقط ، ثم أحال جميع المتهمين على اختلاف مواقفهم للمفتى لاستطلاع رأيه فى إعدامهم وكذلك القاضى شيرين فهمى الذى قضى بمفرده دون عضوى الدائرة بإعدام المتهمين فى قضية عادل حبارة وهى مخالفة صارخة تدل على مدى جبروت القاضى، وأحمد جمال الدين عبد اللطيف الذى منع موظفى المحكمة من استلام صحيفة التقرير برده والمستشار أيمن عباس من قضاة البيان وقضاة من أجل مصر ، كما منع الموظفين من قيد طعن هؤلاء القضاة على الحكمين بالنقض وكلها إجراءات باطلة لاتستند إلى قانون من قريب أو بعيد ولكنها تحقق هوى السلطة .
خامسا : .إن الكثير من القضاة بات أكبر همه هو إرضاء السلطة القائمة سواء لنيل رضائها عنه ، أو اتقاء شرها وانتقامها منه وأصبحت أحكامهم ناطقة بخضوعهم للنظام السياسى ، ومن ذلك حكم محكمة الأمور المستعجلة باعتبار كتائب القسام جماعة إرهابية ، بينما تقضى فى دعوى اعتبار اسرائيل دولة إرهابية بعدم اختصاصها بنظر الدعوى والحكمان من محكمة واحدة وكلاهما يحقق أهداف النظام دون نظر لحكم القانون ، كما قضت ذات المحكمة بوقف تنفيذ حكم االقضاء الإدارى ببطلان التوقيع على اتفاقية ترسيم الحدود مع السعودية رغم عدم اختصاصها بنظر الدعوى بنص القانون والدستور ، وليس ذلك لخطأ فى فهم القانون ، ولكن لفساد واختلال فى نفس القاضى الذى جعل همه إرضاء الحاكم وحسب .
.سادسا : أسرف الكثير من القضاة فى الحكم بأقصى العقوبة المقررة قانونا ودون سند من القانون سواء كانت العقوبة هى الإعدام أو السجن المؤبد ، ففى قضية اقتحام مركز شرطة مطاى قضىت دائرة سعيد يوسف بإعدام 37 متهما ، وبالسجن المؤبد على 394 متهما وقضى بنقض الحكم وإعادة المحاكمة فقضت المحكمة بإعدام 12 متهما وبالسجن المؤبد على 140 متهما ، وببراءة 238 متهما كان محكوما عليهم بالإعدام والمؤبد ، والخطير فى الأمر هو ماقالته أرملة نائب المأمور المجنى عليه فى إحدى قنوات التليفزيون المصرى من أن المتهمين المحكوم عليهم ليسوا هم من قتلوا زوجها وأن من قتلوه مازالوا هاربين ، وفى قضية كرداسة قضت دائرة ناجى شحاته بإعدام 183 متهما وتم نقض الحكم لابتنائه على التحريات وحدها ، ، وبعد إعادة المحاكمة قضى بإعدام 20 متهما فقط وبراءة 21 متهما ممن قضى بإعدامهم ، بالسجن للباقين بين المؤقت والمؤبد ، وفى قضية غرفة عمليات رابعة قضت المحكمة بإعدام 14 متهما وبالسجن المؤبد ل 37 متهما ، وتم نقض الحكم وفى إعادة المحاكمة قضى بإلغاء عقوبة الإعدام ومعاقبة 3 فقط بالسجن المؤبد ، وبالسجن 5 سنوات ل15 متهما وبراءة 21 متهما ممن كان محكوما عليهم بالإعدام والمؤبد . وفى الجناية 58 لسنة 2015 عسكرية والخاصة بقتل 4 أشخاص والشروع فى قتل 8 آخرين والتعدى على المنشآت العامة واستعمال القوة والعنف مع الشرطة والجيش تم تقديم 116 متهما قضت المحكمة عليهم جميعا بالسجن المؤبد وكان من بينهم الطفل أحمد قرنى شرارة البالغ من العمر 4 سنوات وقدم دفاعه شهادة ميلاده للنيابة العامة وللمحكمة ، وسمير عبد الرحيم الموجود خارج البلاد وقت الحادث وقدم دفاعه شهادة مصلحة الجوازات التى تثبت ذلك.، وفى الجناية 5192 لسنة 2015 الدقى قضت المحكمة بإعدام 11 متهما وبالسجن المؤبد ل 14 متهما واستندت فى إدانتها لعدد من المتهمين من بينهم عبد الرحمن محمد حسن إلى التحريات وحدها ، وقضت بإعدامه ، ويقينى أنه لو تمت هذه المحاكمات وغيرها فى الظروف الطبيعية لما كانت الأحكام بهذه البشاعة .
سابعا : تولى إعلام الانقلاب الدعوة علنا لتصفية المتظاهرين فورا ، ودعى الشرطة لذلك بدلا من القبض على المتهمين وإضاعة الوقت فى المحاكمات كما حدث فى مظاهرات المطرية ، ونادى بتصفية المتهمين حتى ولو كانت الشرطة قد تمكنت من القبض عليهم كما حدث فى واقعة قتل الدكتور محمد كمال وياسر شحاته
والأمثلة لاتخضع لحصر ، الأمر الذى يكشف بوضوح أن هذه السلطة تسعى للانتقام من خصومها السياسيين وكل من يعارضها سواء بالتصفية الجسدية بعيدا عن القانون ، أو بأحكام الإعدام فى ساحات المحاكم ، وأن المحاكمات فى هذه الفترة تفتقر إلى ضمانات المحاكمات العادلة ، وأن المحاكم تتعمد مخالفة القانون لتصل إلى الأحكام التى ترضى السلطة ولو لم تكن هناك أدلة سوى التحريات التى تستند إليها المحاكم وحدها حتى فى الحكم بالإعدام وهو أمر بالغ الخطورة على المتهمين ، وعلى العدالة وعلى القضاء ، ولم تفلح كل الانتقادات التى وجهت للقضاء والمحاكمات من الداخل والخارج لكبح جماح آلة الانتقام ووقف نزيف الدم المصرى الذى يهدر تارة من ضابط بطلقة رصاص ، وتارة أخرى بحكم دون دليل معتبر قانونا من قاض عسكرى أو مدنى .
لذلك
اطالب بضرورة إصدار قانون بوقف تطبيق عقوبة الإعدام مؤقتا حفظا لدماء بريئة قد تزهق ظلما وليس اجتراء على حكم الله عزً وجلً .حتى يأذن الله لمصر بالنصر والاستقامة على شرعه ، وينقذها من هاوية الانقلاب.

A testimony and demand to suspend the death penalty temporarily
I, Judge Ahmed Soliman, the former Egyptian Minister of Justice, do hereby bear witness that the existing regime in Egypt flouts the laws and the constitution, does not care about them, and is motivated by a deep desire to purge its opponents. Moreover, the Egyptian judiciary—both civil and military—is facing a crisis that it has never faced before. It violates the provisions of laws openly and deliberately, does not care about the violation of the right to defense, and sentences—in many lawsuits—hundreds of the regime’s opponents to life imprisonment and execution without significant legal evidence and according to the investigation reports alone. Hence, the public opinion’s confidence in the judiciary judgments has been broken at home and abroad. Further, International human rights organizations are viewing it as a tool of revenge in the hands of the regime based on the following evidence:
Firstly, the authority in existence since the coup d’état, has charged many of the Egyptians with some acts that are not punishable by law. However, the Public Prosecution decides to imprison them, as happened with the child who was caught having a ruler with “Rabia” symbol, or the boy who was wearing a T-shirt with the sentence “A homeland without torture” printed on it, who was sentenced to two years in prison, not to mention many other cases. Furthermore, others were accused and brought to trial for charges that were proved false, such as the case of sewerage blockage in Alexandria in which the Muslim Brotherhood were accused of commit and were brought to trial in spite of the statement given by the General Bureau that the sewerage was blocked as a result of dumping concrete blocks therein during the establishment of a number of clubs close to it from about twenty years ago. However, around 33 accused were brought before the military court, which sentenced 12 of them to life imprisonment, and sentenced the 21 accused left to 15 years in prison.

Secondly, the Egyptian National Council for Human Rights has reported in several reports that the main problem is the expansion of the decisions of preventive detentions, which itself constitutes an irreparable punishment. Some also indicated that the renewal of detention is done in the absence of the accused, which contradicts the law and that is well known to the authority that renews preventive detentions.

Thirdly, the existing authority relies on the method of falsifying investigation reports as an instrument of revenge against anyone it wishes to retaliate against. “Mekameleen” TV has broadcasted a recording for the national security officer who has edited the investigation report of the “Ettehadiya Case”. He admits that he formulated it out of his own imagination to get rid of President “Morsi” and his group. Moreover, investigation reports of the cases of “Judges of the Statement” and “Judges for Egypt”, which contain fabricated and baseless facts. The judges have challenged them for forgery before the two Boards of Discipline and submitted two statements to the Attorney General. Nevertheless, those allegations have not been filed neither in the Public Prosecution nor in the two Disciplinary Boards.

Fourthly, the circuits for terrorism were formed from judges who were appointed to adjudicate certain cases. Many of them were subject to suspicion. Some of them had some open investigations that were closed before those courts were formed. Many of those courts have violated the rules of law and the guarantees of fair trials. Many of them have failed to abide by the rules of law and guarantees of fair trials. As did the circuit of Judge Said Youssef by refusing to grant duration to the accused to recuse the court in the cases of the storming into el-Idwa and Matai Police Stations, not hearing the defense of the accused, and considering the two cases—in which the number of accused in each of them exceeded 500 accused—in a few hours in two sessions only, and then referring all accused regardless their different positions to the Mufti to review his opinion on their execution. Similarily, Judge Sherin Fahmi, who has alone—without the two other members of the circuit—to sentenced to death penalty all the accused in the case of “Adel Habara”, which is a blatant violation that expresses how arrogant is the judge. Let alone Judge Ahmed Jamal el-Din Abdul-Latif who prevented the court clerks from receiving from the “judges of the statement” and the “Judges for Egypt” the report demanding the recusal of him and Judge Ayman Abbas. Not to mention preventing the clerks from accepting the appeals of cassation from those judges on the two judgements. All of those procedures are void and are not based on the law, but it rather satisfies the regime’s arrogance.

Fifthly, many of the judges have become more interested in appeasing the existing regime, whether to gain its satisfaction, or to prevent its evil and revenge from him. Their rulings have become very clear evidence of their submission to the political regime, including the ruling of court of urgent matters that the Qassam Brigades are a terrorist group. While in a case that considers Israel a terrorist state, it decided that it does not have jurisdiction to hear the case while the two judgements were pronounce by the same court and both of them achieve the objectives of the regime without regard to the rule of law. The same court also pronounced a judgement that stops the execution of the administrative court ruling invalidating the signing of the border demarcation agreement with Saudi Arabia, although it does not have jurisdiction to consider the case in the provisions of the law and the constitution. That was not because of an error in interpreting the law, but because of the corruption and imbalance of the judge who made his concern is to satisfy the ruler only.

Sixthly, Many judges have too many times sentenced the accused to the maximum sentence prescribed by law without any legal basis, whether the penalty is death or life imprisonment. In the case of the storming into Matai Police Station, the circuit of Judge Said Youssef has sentenced 37 accused to death and 394 to life imprisonment. After the challenge of judgement was accepted and after retrial, the court sentenced 12 accused to death and 140 to life imprisonment and acquitted 238 accused who were sentenced to death and life imprisonment. What is really serious in this regard is what the widow of the victim deputy officer said to one of the Egyptian television channels. She stated that the convicted accused were not the ones who killed her husband and that those who killed him were still fugitives. Moreover, in “Kerdasa case”, the circuit of Naji Shehata has sentenced 183 accused to death. However, the ruling was appealed because it was based on investigation reports only. After the retrial, 20 accused only were sentenced to death, 21 accused of those who were sentenced to death have been acquitted, while the rest were sentenced to prison and life imprisonment. In the “Rabia Chamber of Operations case”, the Court sentenced 14 accused to death and 37 to life imprisonment. After the judgment was appealed and in the retrial, the death penalty was canceled, 3 accused only were sentenced to life imprisonment, 15 accused were sentenced to 5 years’ imprisonment, and 21 accused from those who were sentenced to death and life imprisonment, were acquitted. In the felony no. 58 of the year 2015/Military, on killing 4 people, kill attempt of 8 others, attacking public facilities, and used force and violence with the Police and Army, 116 accused were brought to trial and were all sentenced to life imprisonment. Among them was the child “Ahmed Qorani Sharara”, 4 years old, whose defense submitted a birth certificate to the Public Prosecution and the Court. In addition to “Samir Abdul-Rahim” who was abroad at the time of committing the crime, however, his defense submitted the certificate proving that from the Passports, Emigration & Nationality Administration. And in the felony no. 5192 of the year 2015/Dokki, the court sentenced 11 accused to death and 14 accused to life imprisonment. It based the conviction of a number of the accused, including Abdel Rahman Mohammed Hassan, on the investigation reports alone, and sentenced him to death. I believe that if such trials and other ones had been in normal circumstances, the judgements would not have been that horrible.

Seventhly, the media of the coup d’état has publicly called for the immediate liquidation of the demonstrators. It called the police to do that instead of arresting the accused and wasting time in the trials as happened in the demonstrations of El-Matareya. It called for the liquidation of the accused even if the police had already arrested them, as happened in the killing of Dr. Muhammad Kamal and Yasser Shehata, and the examples are countless. This clearly reveals that this regime seeks to avenge its political opponents and anyone who opposes it, either through physical liquidation out of the law or the death sentences in the courts, and that trials in this period lack guarantees of fair trials, and that the courts deliberately violate the law to pronounce the judgements that satisfy the regime, even if there was no evidence other than the investigation reports on which the courts solely rely even in death sentences, which is very serious to the accused, justice, and the judiciary. All criticisms directed to the judiciary and trials from inside and outside did not succeed in curbing the vengeance machine and stopping the bleeding of the Egyptian blood, which is wasted sometimes by an officer’s shot, and sometimes by a judgement without any legal evidence from a military or civilian judge.

So
I demand that a law be issued to stop the application of the death penalty temporarily, to save the blood of innocent people that may be unjustly wasted and this is not meant to violate the rule of Allah Almighty. That is until God grants Egypt victory and righteousness on his law and saves it from the hell of the coup.
